RAJKOT: A court in Rajkot district, Gujarat, has sentenced a man with 90% physical disability to 20 years of rigorous imprisonment after convicting him for the rape of a 15-year-old minor girl.

The incident came to light last year in a village near Bhayavadar. On February 4, Ali Hussain Mohibulla Sheikh, the Special POCSO Judge of the Dhoraji District Additional and Sessions Court, pronounced the verdict. The convict, Suresh Dalsingbhai Mavi, has been sentenced to 20 years of rigorous jail time and a fine of ₹5,000. Additionally, the court ordered the government to pay ₹7 lakh as compensation to the victim.

According to the police investigation:
On June 12, 2025, Suresh Mavi, with the help of an accomplice, kidnapped the minor.
He allegedly lured her with the promise of marriage.
The victim was then taken to Ahmedabad, where she was repeatedly sexually assaulted against her will.
Medical Evidence vs. Defense Arguments
The defense counsel argued for leniency, claiming that since Suresh Mavi suffers from 90% disability in both legs, he was physically incapable of performing a sexual act.
However, the court relied on the medical testimony of Dr. Ashok Kanani. The medical report and supporting evidence confirmed that the accused was physically capable of sexual intercourse. Rejecting the defense's argument that disability equates to incapacity to commit such a crime, the judge convicted him under Section 6 of the POCSO Act.
Additional Orders
Fine Default: If the convict fails to pay the ₹5,000 fine, he will face an additional three months of simple imprisonment.
Victim Support: The court emphasized the mental trauma faced by the victim and ordered a ₹7 lakh rehabilitation package under government schemes.
Absconding Accomplice: A second accused, Sunil Himsing Mavi, who allegedly assisted in transporting the girl to Ahmedabad, remains at large. Police are currently conducting a search to apprehend him.
